B & K Williams Limited (“B&K Williams”, “we”, “us”, “our”) is committed to protecting your privacy. This policy explains what personal data we collect when you use our website www.bandkwilliams.co.uk (the “Site”), including our online finance calculator, why we collect it, how we use it, and your rights under UK data protection law.

B & K Williams Limited is the data controller for the personal data described in this policy.

We are a credit broker, not a lender, and the sale of financial products via B&K Williams is regulated by the Financial Conduct Authority (FCA reference number: 664496). We may introduce you to a limited number of lenders and receive a commission or fee from them if you take out a finance product with them.

2. What personal data we collect

We collect personal data in the following ways:

  • General site use: when you fill in a contact or enquiry form, we collect the details you provide, such as your name, email address, phone number and message content.
  • Cookies and analytics: we use cookies and Google Analytics to understand how visitors use our Site (see Section 5, “Cookies”).
  • Finance calculator: when you use the online finance calculator on this Site, you enter a vehicle price to generate indicative finance quotes. If you choose to apply for Hire Purchase (HP) or Lease Purchase (LP) finance, we and our finance calculator provider will collect further personal and financial information from you as part of that application. See Section 3 for details on how this works.

3. The online finance calculator

The finance calculator on this Site is provided using technology from a third-party finance calculator provider. That provider processes the information entered into the calculator on our behalf, and in some respects as an independent controller, in order to generate indicative finance figures and, where you choose to apply, to pass your application on to a finance provider.

The calculator lets you enter a vehicle price to generate an indicative quote for illustration purposes. This alone does not require your name, contact details, or any other personal or financial information.

The calculator also includes “Apply for HP finance” and “Apply for LP finance” buttons. If you choose to apply, you will be asked to provide further personal and financial information (such as your name, address, date of birth, income, and bank details) in order to submit a finance application. Where you do this:

  • your data is shared with ourselves, as the credit broker introducing you to finance; and
  • your data is shared with the finance provider (lender) you apply to, who will assess your application, which may include carrying out a credit search;
  • your data passes through our third-party finance calculator provider, who facilitates the application process on our behalf.

We will not enable a full application journey without first updating this policy if the scope of data collected changes.

Lawful basis: we process this data on the basis of our legitimate interests in providing you with useful tools to help you plan a vehicle purchase, and, where you choose to apply for finance, in taking steps at your request prior to entering into a contract, as well as to comply with our regulatory obligations as a credit broker.

4. How we use your personal data

We use personal data you provide to us to:

  • respond to your enquiries and provide the information or services you have requested;
  • operate and improve our Site, including the finance calculator;
  • meet our legal and regulatory obligations, including those under FCA rules; and
  • where you have separately agreed, send you marketing communications (you can opt out at any time).

5. Cookies

Our Site uses cookies, which are small text files placed on your device. We use:

  • Essential cookies needed for the Site to function correctly;
  • Analytics cookies (Google Analytics) to help us understand how visitors use the Site, so we can improve it; and
  • Functional cookies used by our third-party finance calculator to allow it to operate correctly on the page.

You can control or delete cookies through your browser settings at any time. Blocking some cookies may affect how the Site, including the finance calculator, functions.

6. Who we share your data with

We may share personal data with:

  • our third-party finance calculator provider, who provide the technology behind our finance calculator and application process;
  • finance providers (lenders), if you choose to apply for HP or LP finance through the calculator, so they can assess your application;
  • Google, for website analytics, in accordance with Google’s own privacy policy;
  • service providers who help us run our website and business (for example, our web developer, Brandified Ltd); and
  • regulators, law enforcement, or other third parties where we are required to do so by law.

We do not sell your personal data to third parties.

7. How long we keep your data

We keep personal data only for as long as necessary for the purposes described in this policy, or as required by law or FCA record-keeping requirements. Enquiry and contact form data is typically retained for as long as needed to deal with your enquiry and for a reasonable period afterwards in case of follow-up queries.

8. Your rights

Under UK data protection law, you have the right to:

  • access the personal data we hold about you;
  • have inaccurate data corrected;
  • ask us to delete your data in certain circumstances;
  • restrict or object to certain processing;
  • request that your data be transferred to another organisation; and
  • withdraw consent at any time, where we rely on consent.
